Norberto Bobbio resume que el concepto político-jurídico del término “sirve para indicar el poder de mando en última instancia en una sociedad política y, por consiguiente, para diferenciar a ésta de otras asociaciones humanas, en cuya organización no existe tal poder supremo, exclusivo y no derivado”. Así, la idea de poder supremo define a la soberanía y su presencia es inherente a la aparición del Estado. Con las revoluciones burguesas el concepto pasó de la idea del poder supremo del Estado a la del poder supremo de la voluntad general del pueblo o la nación.

Entre las principales características que describen a la Soberanía es que es absoluta, perpetua, indivisible, inalienable e imprescriptible. Es absoluta porque define a un poder originario que no depende de otros ni está limitada por las leyes, es perpetua porque su razón trasciende a las personas que ejercen el poder y a diferencia de lo privado es imprescriptible e inalienable.

Otra descripción del término se puede entender desde tres ópticas de su carácter: 1) limitada, 2) absoluta y, 3) arbitraria. La primera concibe la soberanía como Locke, la cual tiene límites naturales en el contrato del que surge (Constitución) y por el pueblo, de quien es un mandatario; la segunda, pregonada por Hobbes y Rousseau, contempla que el poder soberano no tiene límites jurídicos pero su poder obedece a una racionalidad técnica o moral (voluntad general); y la tercera que considera que el Poder Soberano es la expresión en ley del interés del más fuerte.

Según la Constitución Política en México, la Soberanía reside “esencial y originariamente en el pueblo. Todo poder público dimana del pueblo y se instituye para beneficio de éste”. También abunda que “el pueblo ejerce su soberanía por medio de los Poderes de la Unión, en los casos de la competencia de éstos, y por los de los Estados y la Ciudad de México, en lo que toca a sus regímenes interiores, en los términos respectivamente establecidos por la Constitución Federal y las particulares de cada Estado y de la Ciudad de México”.
